Only thing left to fear is fear itself. And I KNEW in an instant I would be fine. Then Donna came too with her Tahoe. And off we went. The snow stopped, and we Got R done in hour 45 min. Came home to a White out. And now blue skies. Gave them my baby freezer & a heater, they wanted no $. Unreal. Was only going to charge me $30. I was so overwhelmed with everyone's help. Mostly everything is packed now. That storage unit rocks. Wonder when my hands & tooties will be warm. My thinking bench yesterday, could not get to it. Spent many a hour at the park. Keep it in my heart. lol, those silly swans looking for food.

Mim!!!!!! your 97.4% packed!!!!!!! the music even sounds sweeter. Balmy 32 out, fog coming off the fields of snow. Boney Andrew was here last night with his future granddad. Took my junk & trash away. He is all grown up. Isis is doing great. Big Shirlee ...is going to college and Nikki has 2 kids and is married too.! unreal. Such a nice young man he is. Ming is going to get her Spring haircut today, her hands are bothering here again.... poor lil creature. |

    And so it begins, Got good council on leaving the farm early. I needed to be gone from that life. Start a new. Ming& I got KFC, and now we are hangin at the Comfort Inn. Well worth every cent. Just for the peace of mind alone. Tomorrow I stay at daddy.s for 2 days then to Star's for 2 days. Maybe go to class tomorrow to say goodbye to everyone. I can leave Mingy at daddy's |

Moonda, who is accused of hiring her lover to kill her husband, Dr. Gulam H. Moonda, are asking a judge to declare the federal death penalty unconstitutional. U.S. Attorney Office, Cleveland, has asked that Mrs. Moonda, 47, be put to death if she is convicted of the three of the four charges against her: murder for hire and two aiding and betting charges. She also is charged with a fourth aiding and abetting charge. Mrs. Moonda’s basic argument is that the Federal Death Penalty Act is unconstitutional because it allows facts to be presented to a jury during the sentencing phase — after a conviction — that have not been subject to the Federal Rules of Evidence or a defendant’s right to question witnesses. A congressional fix to this problem that allows an indictment to contain a section of “special findings” that detail what elements could bring about the death penalty also is unconstitutional because it allows the Department of Justice to ask a grand jury to charge sentencing factors as elements of the initial crime. Mrs. Moonda’s attorneys said the Constitution prohibits the DOJ, a part of the executive branch, from defining the elements of a criminal offense, which is the purview of Congress. Among the special findings in Mrs. Moonda’s indictment are that she planned to cause her husband’s death, and that she expected to receive something of value — his estate. Also concerning the sentencing phase, the attorneys are trying to prevent the government from presenting testimony about the impact Dr. Moonda’s death has had on his family, friends and patients. Federal law permits evidence presenting “the effect of the offense on the victim and the victim’s family.” This testimony is allowed to present a “quick glimpse” of the victim and show his or her “uniqueness as an individual.” Information about Dr. Moonda’s impact on the community because of his skill as a physician goes beyond the quick glimpse allowed, attorneys Roger M. Synenberg, Lawrence J. Whitney and David L. Grant said. In other motions filed Thursday and Friday, the attorneys: ä Seek permission to question jurors who have found her guilty, and exclude them from the sentencing phase if they say they automatically would vote to put her to death. ä Seek to prohibit the use of the term “the guilt phase” during her trial because it could lead some jurors to conclude she is guilty. ä Ask for more time to file additional motions because a psychological evaluation of Mrs. Moonda has not been completed, and the fact the government turned over information on Feb. 20, three days before motions were due. ä Seek a bill of particulars from the government outlining specific acts and information the government plans to allege Mrs. Moonda committed, including her dealings with her lover, Damian Bradford, the weapon used, and what financial benefit she would derive from her husband’s death. ä Ask for information the government has that could be favorable to Mrs. Moonda’s defense. ä Seek to exclude jurors who cannot look beyond the crime to consider mitigating factors in determining punishment.
